What is a Substantial Failure?

A substantial failure occurs when:

  • A reasonable consumer would not have purchased the goods if they had known about the failure
  • The goods are significantly different from what was described or demonstrated
  • The goods are substantially unfit for their normal purpose and cannot easily be made fit
  • The goods are unsafe
